Did you know a goal of the Beaverhead County Resource Use Committee (BCRUC) is to support the development and revision of Beaverhead County Comprehensive Plan; to include all resources upon which county customs, cultures, and economy are dependent; provide county government with a tool that will enable the county to effectively influence government and non-government entities when making decisions that affect environment, customs, cultures, and economy of the people of Beaverhead County?

03/20/2002 Entry: "Hearing on Draft Wild and Scenic Eligibilty Report"

Beaverhead County Commissioners, the Beaverhead County Planning Board, and the Beaverhead County Resource Use Committee will hold a joint public hearing on the 25 day of March 2002, at 7:00 p.m. in the Search and Rescue Building.

The purpose of this hearing is to solicit public input regarding the BLM’s Draft Wild and Scenic Rivers Eligibility Report.

The Commissioners set up a joint hearing in order to get public input in developing the County’s formal comments on the BLM March 2002 Draft Wild and Scenic Rivers Eligibility Report document.

* “Hearing” is the legal term that signifies the Commissioners are considering public comment on a specific issue.
* “Joint” hearing means the Commissioners, Planning Board and Resource Use Committee are holding/sponsoring this opportunity for public comment.

In this context, the hearing does not involve a presentation of facts or information by the BLM or Commissioners, it is an opportunity for the Commissioners to listen to the public. The BLM has offered to make a formal presentation and/or formally participate at this hearing and the County declined that offer. The County thought the BLM’s formal participation would make it more difficult to explain the County’s hearing and comment process as a parallel process, but separate from the BLM’s NEPA Wild and Scenic River nomination process.

The purpose of this hearing and comment process is to incorporate the guidance Wild and Scenic River goals and objectives of the July 2001, Beaverhead County Resource Use Plan, incorporate public comment and develop comments specific to the March 2002 Draft Eligibility Report. Page 41 of the Resource Use Plan provides the following broad Wild and Scenic River guidance:

1. GOAL: Beaverhead County will take a proactive approach in the designation and management of any Wild and Scenic River segments or similar designations in Beaverhead County.

Objective 1A: The County will develop its own management plan for any proposed Wild and Scenic River segment or similar designation in the County.

Objective 1B: Uphold the legal requirements and qualifications set forth by the Wild and Scenic Rivers Act including those providing for the continuation of existing uses, and the regulation of existing uses only so as to prevent unnecessary or undue degradation of the environment.

Objectiver 1C: Review any proposed Wild and Scenic River recommendations in relation to the impacts on natural resource based industries, the economic stability of the County, and on the custom and culture of the citizens of Beaverhead County.

The Commissioners will consider the oral and written comments presented at this joint hearing in the preparation of the County’s formal comments. At this time, it appears the County will provide comments on the following areas:

* Eligibility of each the listed stream segments in Beaverhead County.

* Comments on the Wild and Scenic nomination process.

* Questions to be considered in the suitability phase.

 
As a NEPA cooperating agency, the County has the obligation to provide written comments on the Draft Eligibility Report in the following format:

* State “no comment” on those sections where the County has no comment.

* Affirmitively comment on those sections where the County is in agreement.

* Critique and comment on those sections where the County is not in agreement or believes may be erroneous. In its critique, the County must also include a suitable alternative that it believes will satisfy the issue.

This hearing provides the public the opportunity to provide the Commissioners with verbal and written comments. The Commissioners will then consider the public input when developing comments to submit by the April 30 deadline.
